482 Temporary Skill Shortage Visa

Introduction to TSS(482) Visa Program

The 482 visa, also known as the Temporary Skills Shortage Visa, is a visa designed by the Australian Government for Australian businesses to recruit professional or skilled workers from overseas. The main purpose of this visa is to provide Australian businesses with a flexible way to quickly fill skilled worker shortages in response to the needs of the Labour market. The applicant must be nominated by an Australian employer and the employer is required to sponsor the applicant's job position and ensure that he/she works for that employer during his/her stay in Australia. The Australian 482 employer-sponsored Visa is a temporary visa category in the employer-sponsored visa series, which is divided into short, medium and long term visas and Labour agreements for up to 4 years (up to 5 years for Hong Kong applicants). The visa allows Australian employers to sponsor skilled Australian/overseas workers to address shortages in the Australian Labour market. TSS(482) visa nominees need to have held at least 2 years of full-time relevant work experience in the last 5 years. From 25 November 2023 onwards, all 482 applicants will be able to apply for a 186 employer-sponsored permanent residence visa if they meet the conditions. For example, if an employee holds a 482 visa and has worked for his or her employer for at least two of the three years preceding the submission of the 186 nomination, he or she may apply for the 186 nomination.

· Applicants must meet the TSMIT Temporary Skilled Migration income threshold (currently $73,150)


English requirements:


· Short-term visa: IELTS average score 5, single score 4.5

· Mid-term visa: IELTS average score of 5, no less than 5 for each item

· Australian education can be exempted from English requirement


Work experience Requirements:


From 23 November 2024, the work experience requirement for TSS(482) employer-sponsored visas will be reduced from two years of full-time work experience to one year. The new requirements state that applicants only need to have one year of relevant full-time work experience and be sponsored by an Australian employer with employer-sponsored qualifications to submit an application.


Both short-term and medium-term TSS/482 visas require applicants to have 2 years of work experience, specifically:


· The job must be in the nominated occupation or highly related to the nominated occupation

· Work experience must have been acquired within the past 5 years, either through full-time employment or part-time employment equivalent to 2 years of full-time; Casual employment cannot be counted

· Work experience should be consistent with the ANZSCO responsibilities of the nominated occupation

· Work experience accumulated during the period of study, such as internship, apprenticeship, etc. can be counted if certain requirements are met (e.g., internship, training, etc. during the study of CRISCOS registration courses, and industry specific experience accumulated during the study of PhD or postgraduate courses)


Specific Job Requirements Career Assessment:


· If the applicant is nominated for a specific occupation, the relevant occupation assessment must be carried out at the time of submitting the visa application. It should be noted that when submitting a visa application, the applicant only needs to have submitted the application for vocational assessment, and it is not required to have obtained it


Limits on renewals:


· After 25 November 2023, the limit on the number of 482 short-term visa applications a visa holder can make in Australia is lifted

· After 25 November 2023, applicants can apply for a third short-term visa renewal within Australia

TSS(482) visa requirements for employers

Employer sponsorship eligibility requirements:


· The subject of the application is an enterprise legal person, which must be a legal entity legally registered in Australia and have an ABN number.

· It must be a legally operated enterprise. According to the provisions of Reg 2.59(c) of the Immigration Act, the sponsoring enterprise must not be a shell company and must meet the legal requirements, such as paying taxes on time, having proof of turnover and legal operation, but there is no special limit on the size of the enterprise.

· Have a record of hiring local employees, the company should have a history of hiring local employees.

· There is no adverse information about relevant subjects and individuals, where "subject" refers to the business (ABN), while "individual" includes all shareholders and directors of the company. The term "adverse information" refers to any negative information related to the business.


Employer's obligations as guarantor:


· After obtaining the "Employer guarantee qualification", the employer or enterprise still needs to fulfill the following guarantee obligations to ensure the continuous compliance of the enterprise;

· Notify the Ministry of the Interior within 28 days of the termination of the employment relationship with the insured employee;

· Report to the Ministry of the Interior relevant change information of the enterprise, including name, entity, shareholder, address, contact information and bankruptcy;

· Ensure that visa holders only work in the nominated position;

· Ensure that visa holders have the same or better working conditions as local employees;

· No discrimination in the hiring process on the basis of visa or nationality;

· The obligation to cooperate with investigations, keep records and provide relevant information;

· Bear all sponsorship and nomination related expenses, including immigration agent fees and travel expenses of the sponsor;

· Pay training fees (SAF Levy);


What is SAF Levy:


· Companies with an annual turnover of more than AUS $10 million need to pay AUS $1,800 per year to the government for each employee with a 482 visa sponsored;

· Companies with a turnover of less than $10 million will be required to pay the government A training fee of $1,200 per year for each employee with a 482 visa, with a maximum of $8,000 per company;

· If the company is sponsoring a permanent residence visa, a one-time payment of $5500 is required per application.
