Application conditions
You must meet one of the following criteria: 188A visa applicants on or after 1 July 2021 must have held the visa for at least 3 years ● Hold an 188A visa extension (* Some applicants may be exempted under special circumstances of COVID-19)
Application process

Own and operate a business
In the 2 years prior to your application, you must:
· Operate or manage 1 or up to 2 main businesses in Australia
· Held a direct management role in a business
In the 2 years prior to your application, you must have held at least the following shares:
· 51% - Businesses/businesses with an annual turnover of less than $400,000
· 30% - Businesses/businesses with an annual turnover of $400,000 or more
· 10% - Listed companies
In the 1 year before your application, the annual turnover of the main business reached:
· AUD 300,000
English requirement
· Functional English is required. Any applicant aged 18 or above with substandard English will be charged an additional fee
· If there is no Functional English ability, the second phase fee will be paid (unless the second phase fee has been paid when applying for 188A).
Asset and employee requirements
Within the 12 months prior to the application, you or your spouse (or together with your spouse)
· Must meet at least 2 of the following 3 criteria:
· The applicant has a net worth of not less than $200,000 in a business or enterprise
· Personal and business net assets of not less than $600,000
Employ at least 2 full-time employees (employees must be Australian citizens or permanent residents of Australia, or hold a valid New Zealand passport; And cannot be a member of your family)
· If you acquire a business through the following visa holders, you must prove that you have been in business with the following visa holders for at least 1 year:
888A Permanent resident visa or 890, 891, 892 or 893 Permanent resident business visa
Residence requirement
Meet one of the following residency requirements:
Unless there is a special exemption for COVID-19, you must have physically lived in Australia for at least 1 year in the 2 years prior to applying and meet the application conditions
You must have lived in Australia for at least 1 year in the 3 years prior to your application if you:
· Be invited to apply for 188A on or after July 1, 2021
Be invited to apply for 188A on or after July 1, 2021 and hold the 188A Extension category
· Approved 444 SCV visa on or after 1 July 2021
Unless exempted specifically for COVID-19, the deputy applicant must:
The main applicant (spouse) is invited to apply for 188A on or after 1 July 2021, and the secondary application must have been physically resident in Australia in one of the three years prior to the application
The main applicant (spouse) will be invited to apply for 188A before 1 July 2021, and the secondary application will need to be physically resident in Australia for 1 of the 2 years
