102 The Foreign Adoption Child Visa is a permanent residence visa for an Australian citizen, permanent resident or eligible New Zealand citizen to sponsor a child who is living abroad, is about to be adopted or has been adopted, so that they can live in Australia. This type of visa requires the child to be outside Australia at the time of application and visa approval.

· If you meet the residency requirements, you can apply for Australian citizenship

· Visa-free access to New Zealand

Requirements for applicants (i.e. sponsored adopted children) :

· The applicant must be under 18 years of age at the time of application and visa approval

· Applicants must reside outside Australia

· The applicant is about to be or has been adopted by a sponsor

· Meet health requirements

· If the applicant is over 16 years old, meet the personality and character requirements

Requirements for Guarantors:

Sponsor must be an Australian citizen, permanent resident or eligible New Zealand citizen

· Both the sponsor and the sponsor's spouse must meet the character requirements

The guarantor must meet any of the following conditions:

· The relevant Australian State government adoption agency was involved in the adoption process

· Adoption procedures in accordance with the Hague Convention

· In the case of an overseas adoption, the adoption procedure must comply with the relevant laws of the adoptive country and the sponsor has resided abroad for 12 months prior to the submission of the visa application

· If the sponsor lives outside Australia, the sponsor may choose to adopt from the country of residence or another country, subject to applicable legal requirements.
