Introduction to spousal immigration program
Subclasses 820 and 801 are spousal immigration visas for Australian citizens or permanent residents, or eligible New Zealand citizens who sponsor an overseas spouse to settle in Australia and submit them in Australia. Of the 820 temporary visa requirements, the applicant must also be in Australia at the time of approval. 820/801 Visa application stage: There are two stages to the domestic spouse visa application: the first stage is the 820 temporary spouse visa; The second phase is the 801 permanent resident spouse visa. Both temporary and permanent visas can be submitted at the time of application. Under normal circumstances, the applicant can only obtain 820 temporary spousal visa, two years after the submission of the visa application, the two parties still maintain a real and lasting marriage relationship, and supplement the requirement of relationship materials, the applicant will be able to obtain 801 permanent residence visa, which is to go through the so-called two-year waiting period. * The 820 visa is valid until the 801 permanent residence visa is issued * However, in some special circumstances, it is possible to obtain a permanent residence visa directly. For example, at the time of the visa application, the applicant and the sponsor have been married, maintained a de facto husband and wife relationship for more than 3 years, or extreme conditions such as domestic violence.

Application conditions
· The applicant must be a married/cohabiting spouse (both heterosexual and same-sex), and the marriage and de facto marital relationship must have existed prior to the application
· Both spouses who have registered their marriage in an institution recognized by the Australian Immigration Department and spouses who have registered their marriage in China meet the basic requirements for applying for spousal immigration. The cohabiting spouse must have been living together in the 12 months prior to submitting the visa application and must provide credible documentation to prove it
· A sponsor must be an Australian citizen, a permanent resident or an eligible New Zealand citizen aged 18 years or over. They can only be guaranteed twice in their lifetime, and the interval between guarantees is at least five years. Those who obtained a green card through a spousal visa also need to wait more than five years before they can sponsor their spouse to apply for immigration
