Project introduction

The 802 Domestic Child Visa is a permanent residence visa category where an Australian citizen, permanent resident or eligible New Zealand citizen sponsors a biological, adopted or stepchild under 25 years of age living in Australia to enable them to reside in Australia. This visa requires the child to be in Australia at the time of application and visa approval.

Application conditions

Requirements for applicants (sponsored children) :

· The applicant may be the biological child, stepchild or adopted child of the sponsor

· The applicant must be under the age of 25

If the applicant is under the age of 18, he or she must be single, i.e. unmarried, never in a domestic partner or engaged relationship

· If the applicant is over 18 and under 25 years of age, he/she must be single, that is, unmarried, never had a domestic partner or engaged relationship, and be in a situation where he/she is not financially independent without a full-time job or is a full-time student

· If the applicant is a stepchild, the applicant may also apply for an 802 visa when the sponsoring stepparent has disowned the applicant's biological parents, but the stepparent is still legally responsible for the applicant

If the applicant is an adopted child, the applicant must be under 18 years of age and single at the time of the adoption proceedings

· Meet health requirements

· If the applicant is over 16 years old, meet the personality and character requirements


Requirements for Guarantors:


The sponsor must be the applicant's biological parent, stepparent or foster parent

Sponsor must be an Australian citizen, permanent resident or eligible New Zealand citizen

· Both the sponsor and the sponsor's spouse must meet the character requirements


If the applicant is under the age of 18, the sponsor needs to meet at least one of the following conditions:


· The sponsor has written authorization from all of the applicant's guardians to allow the applicant to leave the country of origin

· The law of the applicant's country of residence permits the applicant to emigrate with the sponsor

· Does not contravene any Australian Family law and relevant court orders.


The applicant must be under 18 years of age at the time of adoption and the sponsor must meet the following conditions:


· The adoption procedure complies with the adoption Convention and a legal adoption certificate is held

· If the sponsor and his or her spouse are deemed suitable parents by the relevant authorities prior to the adoption process, the sponsor will not be approved if they have been convicted or have paid a fine for harming the child

In the case of an adoption within Australia, the adoption proceedings may take place before or after the applicant acquires Australian citizenship or permanent residence status

In the case of an adoption from outside Australia, the adoption process occurred before the applicant acquired Australian citizenship or permanent resident status

· If the sponsor wishes to adopt outside Australia, or if the adoption occurred after the sponsor acquired Australian citizenship or permanent residence status, the sponsor will need to apply for a 102 Foreign Adoption Child Immigrant visa.
